Welcome to Mkt-Viper. By accessing our website, purchasing our subscription plans, or using our indicators on the TradingView platform, you agree to be bound by these Terms of Use ("Terms"). Please read them carefully. If you do not agree with these Terms, you may not use our services or products.

1. GENERAL DISCLAIMER – NO FINANCIAL ADVICE

MKT-VIPER IS NOT A REGISTERED INVESTMENT ADVISOR, BROKER-DEALER, OR FINANCIAL INSTITUTION.

1.1 Educational Purpose Only: The content, tools, indicators (including Mkt-Viper Pro, Mkt-Viper Edge, and Mkt-Viper Momentum Oscillator), and signals provided by Mkt-Viper are strictly for educational and informational purposes. They do not constitute financial advice, investment recommendations, or an offer to buy or sell any assets (including cryptocurrencies, stocks, or futures).

1.2 Assumption of Risk: Trading in financial markets involves a high degree of risk and is not suitable for everyone. You acknowledge that you are solely responsible for your own investment decisions. You should never trade with money you cannot afford to lose.

1.3 No Guarantees: Mkt-Viper makes no representation that the use of our indicators will result in profits or prevent losses. Past performance of any trading system or methodology is not necessarily indicative of future results.

2. SERVICES AND DELIVERY

2.1 Product Access: Upon successful payment, Mkt-Viper grants you a limited, non-exclusive, non-transferable license to use our proprietary indicators on the TradingView platform.
2.2 Delivery Method: Access is granted via the "Invite-Only" scripts feature on TradingView. You must provide a valid TradingView username at checkout.
2.3 Platform Dependency: Our services rely on the TradingView platform. We are not responsible for TradingView downtime, chart data errors, server latency, or changes to the TradingView Pine Script language that may temporarily affect indicator performance.

3. SUBSCRIPTIONS, BILLING, AND REFUNDS

3.1 Payment Plans: Mkt-Viper offers Monthly, Annual, and Lifetime subscription options. By selecting a recurring plan, you authorize us to charge your payment method automatically at the start of each billing cycle.
3.2 Failed Payments: If a renewal payment fails, your access to the "Invite-Only" indicators on TradingView will be immediately revoked until payment is successfully processed.
3.3 NO REFUNDS: Due to the digital nature of our products (proprietary intellectual property), ALL SALES ARE FINAL. We do not offer refunds, returns, or exchanges for any reason, including but not limited to:

Dissatisfaction with the indicator's performance.
Inability to set up the indicator (though support is provided).
Failure to cancel a subscription before the renewal date.

4. INTELLECTUAL PROPERTY & LICENSE RESTRICTIONS

All indicators, source code, and logic provided by Mkt-Viper are the intellectual property of Mkt-Viper.

4.1 Personal Use Only: Your license is for your personal, individual use only.
4.2 Prohibited Commercial Use: You are strictly prohibited from:

Reselling, sub-licensing, or redistributing the indicators.
Creating a "signal group" (e.g., Telegram, Discord) where you sell or broadcast the buy/sell signals generated by Mkt-Viper to third parties.
Reverse-engineering, decompiling, or attempting to derive the source code of the indicators.

5. USER CONDUCT & ACCOUNT TERMINATION

Mkt-Viper reserves the right to terminate your access and revoke your license immediately and without refund if you violate these Terms. Grounds for termination include, but are not limited to:

5.1 Account Sharing: Sharing your TradingView login or Mkt-Viper license with other individuals.
5.2 Leaking Logic: Attempting to copy, clone, or leak the proprietary logic of our scripts.
5.3 Abusive Behavior: Harassment, hate speech, or abusive behavior towards Mkt-Viper staff or community members in our Discord, email channels, or social media.
5.4 TradingView Bans: If your account is banned by TradingView for violating their House Rules, Mkt-Viper is not liable, and we are not obligated to transfer your license to a new account.

6. DATA ACCURACY

Mkt-Viper indicators utilize market data provided by TradingView. We do not guarantee the accuracy, timeliness, or completeness of this data. Market data feeds may experience delays or outages which are beyond our control. Mkt-Viper shall not be held liable for any trading losses resulting from data discrepancies.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MKT-VIPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES.

8. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
